Appellate Briefing

When a party believes a court has ruled incorrectly, they have the option to file a notice of appeal outlining the legal arguments you intend to make to an appellate court. An appeal typically argues that a lower court has misapplied the law. Appeals require the file of legal briefs and other documents. While an appeal is an uphill battle, they are occasionally successful.


Appeals rely on legal argument rather than factual argument. For that reason, a pro se party who has lost a case or had a case dismissed may not be in the best position to explain to an appellate court how the lower court got it wrong.
